These Terms of Service ("Terms") govern your use of the website trishud.com and technical engineering services provided by Trishud Enterprises ("Trishud", "we", or "us"). By accessing our website or engaging our services, you agree to these Terms.

1. Engineering Services & Master Agreements

Custom software engineering, telematics platform integration, and cloud architecture engagements are formalized through specific Statements of Work (SOWs) and Master Service Agreements (MSAs). In the event of any conflict between these general Terms and an executed project SOW, the executed SOW governs.

2. Intellectual Property & Code Deliverables

Unless explicitly agreed otherwise in writing:

• Client Deliverables: Custom application logic, database schemas, and proprietary business workflows developed specifically for a client become client property upon full settlement of contracted invoices.
• Proprietary Platforms: The Vega Platform, including its underlying telematics ingestion decoders, hardware protocol drivers, and core R&D modules, remains the exclusive intellectual property of Trishud Enterprises.
• Open Source Components: Deliverables incorporating permissive open-source libraries (MIT, Apache 2.0, BSD) remain subject to their respective licenses.

3. Warranties & Performance Standards

We adhere to rigorous engineering standards: clean architecture, test-driven validation, and documented deployment procedures. However, software and web services are provided on an "as-is" and "as-available" basis. Specific uptime SLAs and performance guarantees are defined within dedicated enterprise service contracts.

4. Limitation of Liability

To the maximum extent permitted by applicable law, Trishud Enterprises shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or business interruption arising out of website usage or third-party telematics hardware failures.
